		<description>Inconsistencies  in the evidence against Kyle Horace:More reasons why he should not  have been convictedNo form of  sexual assault can be excused. Those who have experienced a forced violation of  their person may receive a life sentence of psychological harm. The perpetrators  may receive a lesser sentence. However, society&amp;#39;s righteous indignation to defend  the victim and punish the offender has often resulted in innocent people being  accused and imprisoned. Inconsistencies in the case against Kyle Horace indicate  that his conviction was unsound and a young man was wrongfully sentenced to seven  years in the Darwin Correctional Centre.The transcript of a rape trial  is not pleasant reading. The complainant, witnesses and accused are forced to  re-live the trauma of a life changing event, in this case after they have grown  from childhood to maturity. However, the frankness and personal nature of the  evidence presented to the court is necessary for the jury to reach a verdict beyond  reasonable doubt. Likewise, distressing evidence for all involved must be here  re-examined if we are to question the verdict of the jury and the comments of  the judge in Kyle&amp;#39;s trial. The future of an innocent man depends upon it. </description>

Kyle  will serve a minimum of five years in the Darwin Correctional Centre, better known  as Berrimah Prison, before being eligible for parole. Kyle was  born of Aboriginal descent in Wyndham, Western Australia on 24th March, 1988.In  late 2006, as a well-built adult he stood in the dock before an all-white Darwin  jury, charged with the rape of a 13-year-old white girl more than three years  previously, in May, 2003. He was tried as an adult, although when the alleged  offence was committed Kyle was legally still a child of 15 years and two months.  The  police did not even move to charge Kyle until August 2005, two-and-a-half-years  after the supposedly violent sexual offence that he vows he did not commit. Bartlett Day       The Mayor of Darwin recently announced that Aboriginal drifters and white trash&amp;#39; would be harassed and driven from the city. Tourists like to see Aborigines but begging is getting worse&amp;#39; he told the Northern Territory News on February 11, 1999. The mayor called for a revival of the harassment campaign which began on Clean Up Australia Day in 1996 when the Darwin homeless were blamed for the city&amp;#39;s litter problems. Later the Chief Minister of the Northern Territory advocated that Aborigines creating a nuisance in public places should be monstered and stomped on by the community&amp;#39; (NT News April 17, 1997). Despite his zero tolerance policy, it was the Chief Minister who was thrown out by his own party. The latest tirade against the homeless was marked only by its racially-specific abuse. It is more usual to lump the homeless together as itinerants&amp;#39; or long grassers&amp;#39;.</description>

Although the town is mainly Aboriginal, remnants of the old colonial administration remain in managerial positions.The Maningrida Progress Association (MPA), which operates the community-owned businesses in the town, was controlled by an  entrenched group of paternalistic balandas (whites) until almost a year ago, when  members of the Aboriginal community organised an election campaign to seize control.  After the successful elections, the new committee promised to make the association  more accountable.</description>
